  This is important information, so please read it carefully.

This document outlines what Patricia Fields, PsyD and any duly appointed representatives agree to provide when you register as a participant for the 2023 Johnson Canyon Workshop and Excursions (herein, “Workshop” and/or “Excursion”), and what you agree to do in return. This waiver is governed under the Laws of the State of Arizona.

No agent, representative, Workshop or Excursion participant or client of Patricia Fields has the right to alter, vary or waive any of these terms and conditions.
 

THE WORKSHOP OR EXCURSION FEE INCLUDES:

• Guided facilitation for the Workshop and Excursion/practices at the various sites

• Leadership as to where to take the group on any Workshop or Excursion

• Energetic transmissions and channeling from the various Elders contained in the Land and in the Elements

• Facilitation of group discussion as to member’s various experiences in the or Workshop or Excursions

 

THE WORKSHOP FEE DOES NOT INCLUDE:

• Airfare and ground transportation to and from the airport to your hotel or to the Workshop or Excursion locations

• Fees for rental cars which are necessary for this Workshop/Excursions

• Accommodations (to be booked independently)

• Entrance Fees to sites or parking fees

• Decision making by Workshop or Excursion leader or her assistants as to the capabilities of group members for any and all activities

• Decision making by Workshop or Excursion leader or her assistants as to where to travel in the area should you depart the Workshop/Excursion group

• Meals/drinks/Snacks

• Facilitation of personal issues as they might arise within and between group members

• Processing of emotional or energetic material that results from the Workshop practices or from the Workshop or Excursions

• Personal or energetic needs following the end of the Workshop/Excursions.

• Travel insurance
   

Itineraries are subject to change: Our Workshop or Excursions can be full of surprises and we need to be flexible enough to take advantage of whatever comes along, so that I may provide you with the best possible Workshop or Excursion. Uncompleted portions of the Workshop or Excursions itinerary are not cause for refund. Changes to itinerary are not causes for refunds. Weather conditions affecting the Workshop or Workshop or Excursion are not causes for refunds. Forces of nature and/or pandemic conditions are not causes for refunds.

 

Workshop or Excursion payments: All payments for the Workshop/Excursions are due at time of registration.                                                                                                                                                                                                                                                                                                                    Cancellations and refunds: All cancellations must be received in writing to fieldspatricia@comcast.net. No refunds after April 1, 2023. Cancellation made prior to that time will be refunded minus a $45 processing fee. 
 

Travel insurance is recommended.  As there are no refunds for the Workshop or Excursions, it is incumbent on the participants to secure travel insurance in the event the Workshop or Excursions need to be cancelled for any reason.  Patricia Fields, PsyD and her agents or representatives assume no liability for any fees incurred by participants as a result of Workshop/Excursion cancellation.    You will want your insurance to cover trip/ Workshop or Excursions cancellation/interruption, recovery of monies associated with loss of airline tickets and hotel expenses, and coverage which includes loss of luggage, trip delay, medical evacuation, etc. Please note that travel insurance companies often require that insurance be purchased within two weeks of your initial Workshop or Excursion confirmation date to include coverage for pre-existing conditions. We suggest that you buy Cancel for Any Reason coverage to include the event of a Workshop or Excursion cancellation.  Please read your insurance policy carefully to see what is and is not covered.  
 

 Workshop or Excursion forms, obligations, and risks: Any pre-existing physical, mental, or emotional disability that may require attention or treatment must be reported prior to the beginning of the Workshop. Omitting important information, or altering this Agreement, will render invalid your Workshop or Excursion participation and you will forfeit any Workshop or Excursion monies paid and could result in expulsion from the Workshop or Excursions at your own expense.  Workshop or Excursion members intentionally assume the many risks inherent in travel and these include risks associated with the content of the Workshop, the risks associated with Excursions and trips in Nature, the risks of driving or being driven by other participants, the risks of travelling on paved and non-paved roads.
 

Special Circumstances: Should a participant, in the sole opinion of Patricia Fields, PsyD or her duly appointed representatives, be considered unsuitable for the Workshop or Excursion, due to being in contravention of any customs or laws of the United States, or by reason of causing inconvenience or annoyance to other Workshop or Excursion participants,  drivers,  Workshop or Excursion guides or others deemed relevant,  or by engaging in behaviors that are incompatible with the safety or comfort of the other members of the Workshop or Excursion, then Patricia Fields, PsyD or her duly appointed representative may disqualify and expel the  participant and ask the participant to return to their accommodation, at their own expense. Under those circumstances Patricia Fields or her duly appointed representatives have the exclusive right, at their discretion, to expel someone (even you) from a Workshop or Excursion at any time, without any claims or complaints by you or against Patricia Fields or her agents, independent contractors, volunteers, participants, employees, and all other persons or entities acting in any capacity on her behalf.

Anyone who appears to be under the influence of alcohol or drugs may at the sole discretion of Patricia Fields, PsyD or her duly appointed representative be prohibited from taking the Workshop or Excursion or removed from the Workshop or Excursion. There will be no refunds for Workshop or Excursion participants who are removed from the Workshop or Excursion or denied entry due to misconduct, intoxication or drug use.
 

Please note the following:  

• The Workshop or Excursion does include a mild to moderate amount of walking

• The Workshop or Excursion could include evening outings in Nature; please bring appropriate headlamps or other equipment for this purpose

• As there are no chairs in certain locations, you may want to purchase a lightweight, portable seat to carry with you

• A small backpack is advised for days when you will be asked to pack your own lunch for a day’s outing

• Please come prepared to deal with your needs for being in the sun. We will attempt to minimize full on sun contact for prolonged periods.

• As the Workshop or Excursion is custom designed and moves to a certain flow, there will be a flexible schedule, allowing us to take advantage of the group energies and the power of the sites and special opportunities as they present themselves

•  Workshop or Excursion itinerary is subject to change due to weather, shifts in a site’s energies, group flow and various other conditions

• Those with special dietary needs may need to plan ahead as many restaurants may not cater to your particular needs; you should be prepared to take snacks with you as we may be out for several hours at a time.

• Always carrying a supply of water is necessary. Drink often to avoid dehydration.

• With the increased heat temperature, there are snakes in Arizona so watch your footing and handholds
   

No smoking is allowed in any car, in hotel rooms and during the presence of other group members.

Workshop or Excursion participation assumes that you are 18 years of age or older.
 

Information provided during the Workshop or Excursion is for your own personal enjoyment. There is no recording allowed of any information or energetic practices by Workshop or Workshop or Excursion members without explicit consent of Patricia Fields, PsyD.  All meditations and energetic practices are copyrighted by Patricia Fields, 2023 with all rights reserved.
 

ADDITIONAL AGREEMENTS, RELEASES, WAIVERS AND ASSUMPTION OF RISK

Simply put:

I acknowledge that this Workshop and Excursion may involve risks, hazards, dangers which may include but are not limited to:

 

• Injuries resulting from walking or being in the sun for periods

• Personal injury and/or death

• Changing weather conditions

• Interactions or encounters with wildlife, insects and plant life

• Equipment malfunction

• Unanticipated energetic effects

• Unanticipated emotional/physical/mental/spiritual/energetic effects

• Negligence or mistakes of other participants/drivers/participant drivers

• Negligence or mistakes on the part of Patricia Fields, PsyD and any of her agents, independent contractors, volunteers, employees or any and all other persons or entities acting in any capacity on her behalf

• Collision or accidents with vehicles,  equipment or structures

• Acts of God, insects, animal or plant life

• Inexperience or unfamiliarity with this Workshop, energies, location, nature excursion

• Violence/criminal/negligent acts of others

• Inadequate or unavailable healthcare facilities or assistance, accidents, allergic reactions (food, plants, insects, etc.)

 

By registering and In consideration of the services of  Patricia Fields PsyD, her agents, independent contractors, volunteers, participants, employees, and all other persons or entities acting in any capacity on her behalf, and by registering for this Workshop or Excursion,  I hereby release, indemnify, and discharge Patricia Fields, PsyD , her agents, independent contractors, volunteers, participants, employees, and all other persons or entities acting in any capacity on her behalf , on behalf of myself,  my dependents, my children, my parents, my heirs, administrators or  assigns, personal representatives and estate executors  from any and all claims of any nature and from any and all liability, claims, demands, rights or causes of action brought by me or on my  behalf, or by or for any other person, arising from any cause whatsoever out of events related to or occurring before, during or after the Workshop or Excursion. I also release, indemnify, and discharge Patricia Fields, PsyD and her agents, independent contractors, volunteers, participants, employees, and all other persons or entities acting in any capacity on her behalf from any damages, delay, loss, injury, illness or death, arising from any cause whatsoever out of events related to or occurring before, during or after the Workshop or Excursion to the maximum extent permitted.  This release, indemnification and discharge also includes, but is not limited to, the use of any equipment or facilities, including any such claims which allege negligent acts or omissions of Patricia Fields, PsyD, her agents, independent contractors, volunteers, participants, employees, and all other persons or entities acting in any capacity on her behalf.

 

 Also:

1. I acknowledge that my participation in the Workshop or Excursion and any and all activities related to the Workshop or Excursion entail known and unanticipated risks that could result in physical/medical, emotional, mental, spiritual/energetic and/or financial injury, death, or damage to myself, to property, or to third parties. I understand and acknowledge that Patricia Fields, PsyD and her agents, independent contractors, volunteers, participants, employees, and all other persons or entities acting in any capacity on her behalf have difficult jobs to perform. They might be unaware of a participant's fitness or abilities in any realms including, but not limited to physical/medical, emotional, mental, spiritual/energetic and/or financial aspects.  They might misjudge the participant abilities mentioned above as well as the weather, the elements, or the terrain. They may give inadequate warnings or instructions, and equipment being used might malfunction.  I acknowledge that I am solely responsible for seeking any medical care or independent advice if I suspect that I need to or suspect that my physical condition may be incompatible with the Workshop or Excursion.

 

2. By participating on this Workshop or Excursion with Patricia Fields, PsyD, her agents, independent contractors, volunteers, participants, employees, and all other persons or entities acting in any capacity on her behalf, I assume all responsibility for any health-related issues and/or pre-existing conditions, physical/medical, emotional, mental, and spiritual/energetic as well as financial issues which may arise as a result of the Workshop or Excursion.  Costs in respect of any accident or illness, which require physical/medical, emotional, mental, spiritual/energetic attention are the Workshop or Excursion participants’ responsibility and Workshop or Excursion participants assume all personal and financial responsibility for any and all risks arising from and participating in the Workshop or Excursion, including, but not limited to the risks described in this Agreement.
 

3. Should Patricia Fields, PsyD, her agents, independent contractors, volunteers, participants, employees, and all other persons or entities acting in any capacity on her behalf or anyone acting on their behalf be required to incur monetary damage, attorney's fees and costs to enforce this Agreement, I  agree to indemnity and hold them harmless tor all such fees and costs.
 

4. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself.  I further certify that I assume the risk of any physical/medical, emotional, mental, spiritual/energetic and or financial condition  I may have.
 

5. In the event that I file a lawsuit against Patricia Fields, PsyD, her agents, independent contractors, volunteers, participants, employees, and all other persons or entities acting in any capacity on her behalf, I agree to do so solely in the state of Arizona, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this Agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect in such a way that ensures provisions having the same economic effect.
 

6. By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in these activities, I may be found by a court of law to have waived my right to maintain a lawsuit against Patricia Fields, PsyD, her agents, independent contractors, volunteers, participants, employees, and all other persons or entities acting in any capacity on her behalf or anyone acting on their behalf on the basis of any claim from which I have released them herein.
 

7. This Agreement contains the entire agreement between and among the parties with regard to the matters set forth herein and shall be binding upon and inure to the benefit of the executors, administrators, personal representatives, heirs, successors, and assigns of each.  Participant is not relying on any promise, representation or understanding not found within the four corners of the Agreement itself. This Agreement or any portion hereof shall not be construed against the drafting party by reason of that party having drafted the Agreement or portion hereof.
 

8. Patricia Fields, PsyD, her agents, independent contractors, volunteers, participants, employees, and all other persons or entities acting in any capacity on her behalf shall not be responsible for any breach of this Agreement caused in part or in whole for any reason outside the reasonable control of Patricia Fields, PsyD, her agents, independent contractors, volunteers, participants, employees, and all other persons or entities acting in any capacity on her behalf.  While this Agreement is governed by the laws of the state of Arizona, Workshop or Excursion participant also agrees to abide by all other applicable laws, treaties and border agreements regarding the participant’s purchase and use of services, Workshop or Excursions, or attractions. Workshop or Excursion participant agrees that Workshop or Excursion participant shall be responsible for complying with all such laws pertaining to the Workshop or Excursion participant’s travel.
 

 9.  Workshop or Excursion participant is responsible for and agrees to reimburse Patricia Fields, PsyD for all reversals, charge-backs, claims, fees, fines, penalties and other liability incurred by her (including costs and related expenses) that were caused by or arising out of payments that the Workshop or Workshop or Excursion participant caused, authorized or accepted.
 

10. The information, software, products, and services published on Patricia Fields, PsyD’ web site may include inaccuracies or typographical errors. In particular, Patricia Fields, PsyD does not guarantee the accuracy of, and disclaims liability for inaccuracies relating to the information and description of the Workshop or Excursion displayed on the website (including without limitation, photographs, list of amenities, general product descriptions, etc.).
 

11. In no event shall Patricia Fields, PsyD, her agents, independent contractors, volunteers, participants, employees, and all other persons or entities acting in any capacity on her behalf   be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with, the use of her web site or with the delay or inability to use this website, or for any information, software, products, and services obtained through this website, or otherwise arising out of the use of this website, whether based on contract, tort, strict liability, or otherwise, even if Patricia Fields, PsyD  and/or her  respective suppliers have been advised of the possibility of damages.
 

12.   Workshop or Excursion participant agrees to be bound by the aforementioned terms and conditions.   Workshop or Excursion participant has read and understood the foregoing and voluntarily agrees to all of the terms and conditions.   Workshop or Excursion participant stipulates that Workshop or Excursion participant is of sound mind, and acting on his/her own free will and without coercion or duress.
 

13. I further acknowledge that if I, as a participant in this Workshop/Excursion drive my own vehicle, or am a passenger in another’s private vehicle in connection with the Workshop or Excursion, that Patricia Fields, PsyD’s auto insurance does not cover such a private vehicle.  I also understand that Patricia Fields, PsyD her agents, independent contractors, volunteers, participants, employees, and all other persons or entities acting in any capacity on her behalf are not responsible for assuring the safety and reliability of such private transportation or driver, or for any non-sponsored activities and travel that I, as participant might choose to participate in before, during or after the Workshop/Excursion and I , as participant therefore accept the risks and responsibilities associated with such private vehicle travel and activities.
 

 This Agreement shall be binding on, and shall inure to the benefit of, the parties to it and their dependents, children, parents, heirs, assigns, personal representatives and estate executors.
 

BY SIGNING THIS ELECTRONIC  FOR IT SERVES AS MYAGREEMENT, I FULLY UNDERSTAND BOTH THE KNOWN AND UNANTICIPATED RISKS INVOLVED WITH THE WORKSHOP/EXCURSION AND I VOLUNTARILY ACCEPT THESE RISKS AND ASSUME ALL LIABILITY, INJURY, OR DAMAGE, THAT MIGHT OCCUR.
